Hi how are you. To prevent other candles makers in my area from using my unique scent names what would I do? Would I have to trademark each scent name?

In reply to Christina Kocienda. Hi Christina, sorry for the late reply! You do not need to register your candle names unless it's something original that you don't want anyone else using. So unless you have your own trademarked name, you don't use TM by the name.

Can i name my candles funny sayings like ” first kid party smell” and not have it registered? Do i still need to put tm by the name? Do i only register a scent i made up if i want to make sure no one copies it? Im still new and this is a little confusing.

Always a good subject! We have people ask us all of the time if they can use our names on their candles. And honestly the ones that are trademarked are only for the fragrances. They can all be used on candles since that is a different form. Thanks again for bringing this up!

I am really confused. Love Spell is trademarked by Victoria Secret, yes, but only for body products. Candles in no way are a body product unless you advertise a soy candle as a massage candle. The reading that I have from slate.com on Trademarks says that “A trademark does not mean, however, that no one else can use your word, phrase, or symbol in connection with any and all goods and services. It means only that somebody else can’t use a similar trademark with similar goods or services.” (http://www.slate.com/articles/news_and_politics/explainer/2002/02/can_you_trademark_the_phrase_lets_roll.html).
Do you have a different understanding?

Love your you tube videos. Am considering making some candles mostly for gift giving. Is your book in print? We don’t have Internet access in our area.
